SHELF CLOUD IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE APP OR ANY OF ITS AFFILIATES BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

3. Limitation of Liability

In no event shall Shelf Cloud or its affiliates be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with Shelf Cloud or the use or other dealings in Shelf Cloud.

4. Beta Stage Software

Shelf Cloud is in the beta stage and should be used with caution and at your own risk. Shelf Cloud does not guarantee the performance or reliability of Shelf Cloud. The use of beta software may involve risks, including but not limited to data loss, for which Shelf Cloud shall not be held responsible.

5. Prohibited Activities

You agree not to:

• Sell, resell, rent, or lease the use of Shelf Cloud to any other person or entity.
• Use Shelf Cloud to store, transmit, upload, or post any infringing, libelous, or otherwise unlawful or tortious material, or any data for which you do not have the necessary consents or rights.
• Use Shelf Cloud or any other Confidential Information for competitive analysis.
